Based on the decision of the Supreme Administrative Court, a rule has been introduced in data boxes from 1 January 2023 that on Saturdays, Sundays and public holidays, there is no automatic delivery of data messages that have not yet been opened by the addressee.
Until the end of 2022, delivery was subject to a ten-day delivery fiction from the date of delivery of the message, regardless of whether the expiry of the ten days occurred on a working day or not, unless the addressee of the message logged into the mailbox earlier. The new regulation postpones the moment of delivery to the next working day, if the ten days from the delivery of the message expire on a weekend or holiday. The message will now only be marked as received after the end of the deadline, i.e. in practice at the beginning of the next day. This newly amended rule is intended to be more favourable for the addressees, as the legal effects resulting from the delivery of a data message will not start on non-working days.
