Conditions of special long-term residence for citizens of Ukraine

On Tuesday 18 February 2025, the comment procedure on the draft Government Regulation on the details of registration for special long-term residence for citizens of Ukraine, which was enshrined in the “Lex Ukraine VII” act, was completed. We already wrote about the changes brought by this law here, including the new institute of special long-term residence.

The Government Regulation sets out more detailed conditions of registration for special long-term residence, such as the period for expressing interest in such residence, the period of registration for residence, the reference date or period for meeting the individual conditions for registration and the income required for registration.

In particular, the key points of the draft Regulation are as follows:

  • The registration process will be divided into two stages:
    • It will be possible to express interest in registration between 1 April and 30 April 2025.
    • The actual registration for residence will take place from 1 September to 31 December 2025.
  • The individual conditions for registration will be assessed as of the following reference dates/periods:
    • Continuous residence in the Czech Republic under temporary protection for at least 2 years as of 31 March 2025.
    • Continuous registration for public health insurance for at least 2 years, including no arrears of premiums, by 31 March 2025.
    • The alien may not be a recipient of a humanitarian benefit between 1 July 2024 and 31 March 2025.
    • The minimum annual aggregate income is set at CZK 440,000, with an increase of CZK 110,000 for each additional jointly registered person for the taxable period of 2024.
    • The alien is a personal income taxpayer in the taxable period of 2024 with a tax return filed no later than 1 May 2025.
    • If the child is of school age, he or she must attend compulsory education by 31 March 2025.

The draft regulation foresees an effective date of 31 March 2025.

Given that the comments – some of which point to the fact that only a narrow group of economically active temporary protection holders will be able to obtain special long-term residence under such strict registration conditions (especially as regards minimum income) – will now be treated and the proposal will then be discussed by the Government, we still need to wait for the final text of the Regulation.
